2. Collection, processing and use of personal data
2.1 General
Personal data is any information relating to an identified or identifiable natural person (e.g. name, address, telephone number, date of birth or e-mail address). Registration and the provision of personal data is required in order to use the contractor's online services. Mandatory data are regularly marked with an *.
2.2 Log files
Each time you use the website, certain information is automatically transmitted and stored in so-called log files on Amazon AWS servers.
These log files are stored for 30 days and then deleted. This data processing is carried out to protect the legitimate interest on the basis of Art. 6 para. 1 p. 1 lit. f GDPR or on the basis of Art. 9 para. 2 lit. a, h GDPR.
The following information in particular is stored in the log files:

2.3 Registration
If you register on the contractor's website, the contractor will collect, process and use the data from you required for the services primarily in order to make these services available to you.
With the express registration by the customer, the following data is collected (insofar as this is entered by the customer himself): First name, surname, e-mail address, street, house number, postcode, town. The contractor determines your country of origin on the basis of the IP address via which you visit the online offer. For this data processing, the contractor obtains your consent (Art. 9 para. 2 lit. a GDPR).
The personal data provided by you during registration will be collected, processed and used by the contractor for the purpose of establishing the corresponding contract, for contract implementation and processing as well as for billing purposes. The legal basis for the aforementioned data processing is Art. 6 para. 1 lit. a, b GDPR.
2.4 Use of the online offer
In the context of using the online offer via the website, personal data is also processed to the extent necessary (e.g. when participating in courses, ...). The legal basis for this is Art. 6 para. 1 lit. b GDPR.
2.5 Disclosure of data to third parties; service providers
As a matter of principle, the data collected by the contractor shall only be passed on if:

you have given your express consent to this in accordance with Art. 6 para. 1 p. 1 lit. a GDPR,

the disclosure is necessary in accordance with Art. 6 (1) p. 1 lit. f GDPR for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not having your data disclosed,

Contractor is legally obliged to disclose data pursuant to Art. 6 para. 1 sentence 1 lit. c GDPR or
-
this is necessary in accordance with Art. 6 para. 1 p. 1 lit. b GDPR for the processing of contractual relationships with you or for the implementation of pre-contractual measures that take place at your request.
In addition, disclosure may be made in connection with official enquiries, court orders and legal proceedings if it is necessary for legal prosecution or enforcement.
Part of the data processing may be carried out by service providers of the contractor (e.g. Google Ad Words). In addition to the service providers mentioned in this data protection declaration, this may include in particular data centres, software providers, IT service providers and consulting companies. If the contractor passes on data to the service providers, they may only use the data to fulfil their tasks. The service providers have been carefully selected and commissioned by the contractor. They are contractually bound to the instructions of the contractor, have suitable technical and organisational measures to protect the rights of the data subjects and are regularly monitored by the contractor.
If these service providers process your data outside the European Union, this may result in your data being transferred to a country with a lower data protection standard than in the European Union (so-called third country). In this case, the contractor shall ensure that the service providers concerned guarantee an equivalent level of data protection by contract or otherwise. Alternatively, in the case of data transfers to third countries, the contractor relies on one of the exceptions under Art. 49 GDPR.
2.6 Quiz
As part of the use of the website, the contractor collects and processes personal data in quizzes. These are used to assess and track learning progress and to complete individual course units. The data is only processed to the extent necessary. The legal basis for this is Art. 6 para. 1 lit. a, b GDPR
2.7 Disclosure of data to credit institutions and payment service providers
The contractor uses external payment service providers (e.g. PayPal (Europe) S.à r.l. et Cie). Depending on which payment method you select in the registration process, the contractor passes on the data collected for the processing of payments (e.g. bank details or credit card data) to the credit institution commissioned with the payment or to payment service providers commissioned by the contractor. The legal basis for this data processing is Art. 6 para. 1 lit. b GDPR. In some cases, the payment service providers also collect this data themselves on their own responsibility. In this respect, the privacy policy of the respective payment service provider applies.
2.8 Data processing for advertising purposes
2.8.1 Information on products and services
If you create an account with the contractor, the contractor will also use your contact details to email you further information relevant to you about the contractor's products and services, as well as related news, promotions and offers, and feedback and other surveys. These e-mails will be sent regardless of whether you have subscribed to the contractor's newsletter or not. You can object to the promotional use of your data at any time by sending an e-mail to service@analystmethod.com or by clicking on the unsubscribe link in the promotional e-mail, without incurring any costs other than the transmission costs according to the basic rates. The legal basis for this data processing is Art. 6 para. 1 lit. f GDPR, according to which data processing is permissible in order to safeguard legitimate interests, insofar as this concerns the storage and further use of the data for advertising purposes (existing customer advertising).
2.8.2 Newsletter
The contractor offers you the opportunity to subscribe to a newsletter in which the contractor informs you regularly about new products, services and news. The contractor uses the so-called double-opt-in procedure for the registration. You will receive a confirmation e-mail at the e-mail address you provided during registration, in which you will be asked to confirm that you wish to receive the newsletter. If you confirm your wish to receive the newsletter, we will store your e-mail address and other personal data from the registration until you unsubscribe from the newsletter and request the deletion of the data.
The contractor uses standard market technologies in the email newsletters with which the interactions with the newsletters can be measured (e.g. open and click rates). The contractor uses this data for general evaluations as well as for the individualisation and further development of the content and customer communication. This is done with the help of small graphics (so-called pixels) and special links embedded in the newsletters. The data collected in this way is linked to your other personal data. However, Contractor can only view aggregated information about the reading behaviour of subscribers and not, for example, whether and when a subscriber has opened a particular email.
The legal basis for this is your consent pursuant to Art. 6 para. 1 p. 1 lit. a GDPR. If you do not wish to receive the newsletter, you can unsubscribe at any time or deactivate graphics by default in your e-mail programme.
2.9 Contact form, other contact
If you send enquiries to the contractor by contact form or fax, your message including the contact data you provide there will be stored and processed accordingly by the contractor for the purpose of processing and answering the enquiry and in the event of follow-up enquiries. The contractor does not pass on this data to any other third parties unless this is necessary within the scope of processing and answering your contact enquiry or you have given the contractor your corresponding consent.
If you contact the contractor within the framework of an existing contractual relationship or contact the contractor in advance for information about the range of services or other services, the data and information you provide will be processed for the purpose of processing and responding to your contact enquiry in accordance with Art. 6 (1) sentence 1 lit. b GDPR. In addition, for the protection of legitimate interests in accordance with Art. 6 para. 1 p. 1 lit. f GDPR for the appropriate response to customer/contact enquiries.
The data you enter in the contact form remains with the contractor until the purpose for the data storage/processing no longer applies (e.g. after processing your enquiry has been completed). Mandatory legal provisions - in particular retention periods - remain unaffected. If you do not wish this, you are welcome to inform the contractor of this using the contact details listed above. Stored e-mail histories will then be deleted by us immediately.
2.10 Use of cookies and associated functions/technologies
The contractor sometimes uses so-called cookies on the website. Cookies do not cause any damage to your computer and do not contain viruses. Cookies serve to make the offer more user-friendly, effective and secure and to enable the provision of certain functions. Cookies are small text files that are stored on your computer and saved by your browser. A cookie contains a characteristic string of characters that enables your browser to be uniquely identified when you return to the website.

The cookie-based data processing is carried out on the basis of your consent pursuant to Art. 6 (1) sentence 1 lit. a GDPR or on the basis of Art. 6 (1) sentence 1 lit. f GDPR for the protection of legitimate interests. 2.10.1 Plug-ins
The contractor uses the following plug-ins on the website: Xing, Twitter, Youtube, Facebook, LinkedIn. These plug-ins are only loaded if you have previously activated the function by giving your consent.
Customer data is usually processed for market research and advertising purposes. In this way, usage profiles can be created based on the interests of the users. Based on these usage profiles, advertisements are then placed within the social networks but also on third-party websites, for example.

Google Analytics and Google Adwords
The contractor uses the functions of Google Analytics and Google Adwords, web analysis services of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, on its website. As part of the processing described below, data is also regularly transmitted to Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). Google Ireland Limited and Google LLC are hereinafter jointly referred to as "Google".
Google Analytics uses cookies (first-party cookies) that enable an analysis of your use of the website. However, this does not mean that the contractor gains direct knowledge of your identity. Google uses the information generated by the cookies on behalf of the contractor to evaluate the use of the website, to compile reports on the website activities and to provide the contractor with further services related to the use of the website and the Internet. This enables the contractor to improve the quality of the website and its content. The contractor learns how the website is used on the basis of statistical analyses and can thus continuously optimise the offer.
The contractor uses Google Analytics with the addition "_gat._anonymizeIp" on the website. In this case, your IP address will already be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area and thereby anonymised.
The information generated by the Google Analytics cookies about your use of this website (for example, time, location and frequency of your website visit, including IP address) is transmitted to a Google server in the USA and stored there.

With each individual visit to our website that is equipped with such a "+1" component, this component causes the browser you are using to download a corresponding representation of the component from Google. This process informs Google which specific page of our website is currently being visited.
According to the information provided by Google, no further analysis of your visit will be carried out if you are not logged into your Google account.
If you visit our site while logged in to Google, Google may collect information about your Google account, the website you recommend, your IP address and other browser-related information when you confirm the "+1" button.
In this way, your "+1" recommendation can be saved and made publicly available. If you call up the contractor's website and are logged in to facebook during this time, facebook recognises which specific page you are visiting through the information collected by the component and assigns this information to your personal account on facebook. Youtube
The contractor uses components on its website in connection with the website Youtube.com (YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA, a company affiliated with Google, Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland).
Among other things, the contractor has integrated YouTube videos into the online offer, which are stored on YouTube.com and can be played directly from our website. These are all integrated in "extended data protection mode", i.e. no data about you as a user is transmitted to YouTube if you do not play the videos. Only when you play the videos will the data mentioned below be transmitted. We have no influence on this data transmission.
By visiting the website, YouTube receives the information that you have accessed the corresponding sub-page of our website. In addition, the above-mentioned basic data such as IP address and time stamp are transmitted. This takes place regardless of whether YouTube provides a user account via which you are logged in or whether no user account exists. If you are logged in to Google, your data will be directly assigned to your account. If you do not want your data to be associated with your YouTube profile, you must log out before activating the button. YouTube stores your data as usage profiles and uses them for the purposes of advertising, market research and/or designing its website in line with requirements. When you visit our website, the LinkedIn plugin establishes a connection between your respective internet browser and the LinkedIn server, so that LinkedIn is informed about your visit to our site with your IP address. If you click on the LinkedIn "Recommend" button and are logged into your LinkedIn account at the same time, you have the option of linking content from our site to your LinkedIn profile page. 2.10.2 Online presence in social media
The contractor maintains online presences in social networks in order to communicate there with customers and interested parties, among others, and to provide information about the products and services.
We operate presences with the following providers: Xing, Twitter, Youtube, Facebook and LinkedIn.
For these information services, we make use of the technical platform and services of the providers. We would like to point out that you use our appearances on social media platforms and their functions on your own responsibility. This applies in particular to the use of interactive functions (e.g. commenting, sharing, rating). When you visit our websites, the providers of the social media platforms collect, among other things, your IP address and other information that is stored on your terminal device in the form of cookies. This information is used to provide us, as the operator of the accounts, with statistical information about the interaction with us.
The data collected about you in this context is processed by the platforms and may be transferred to countries outside the European Union, in particular the USA. We do not know how the social media platforms use the data from your visit to our account and interaction with our posts for their own purposes, how long this data is stored and whether data is passed on to third parties. The data processing may differ depending on whether you are registered and logged in to the social network or visit the site as a non-registered and/or non-logged-in user. When you access a post or the account, the IP address assigned to your terminal device is transmitted to the provider of the social media platform. If you are currently logged in as a user, a cookie on your end device can be used to track how you have moved around the network.
The contractor will also only process the data from your use of our service that you provide to us and that requires interaction. For example, if you ask a question that we can only answer by email, we will store your information in accordance with the general principles of our data processing, which we describe in this privacy policy. The legal basis for processing your data on the social media platform is Art. 6 para. 1 p. 1 lit. f GDPR.
To exercise your data protection rights, you can contact both us or the provider of the social media platform. To the extent that one party is not responsible for responding or needs to obtain the information from the other party, we or the provider will forward your request to the respective partner. Please contact the operator of the social media platform directly for questions about the profiling, processing of your data when using the website. The providers describe what information the social media platform receives and how it is used in their data protection declarations (see below). There you will also find information on contact options as well as on the setting options for advertisements.
2.11 Duration of storage; retention periods
The contractor stores your data for as long as this is necessary for the provision of the online offer and the associated services or the contractor has a legitimate interest in the continued storage. In all other cases, the contractor deletes your personal data with the exception of data that he must retain in order to comply with contractual or legal (e.g. tax or commercial) retention periods (e.g. invoices). Contractual retention periods may also result from contracts with third parties (e.g. owners of copyrights and ancillary copyrights).
The contractor shall block data that is subject to a retention period until the expiry of the period.
3. Your rights
3.1 How can you assert your rights?
Please use the information in the "Responsible person" section to assert your rights. Please ensure that the contractor is able to clearly identify you.
Alternatively, you can also use the settings options in your user account to correct the data you provided during registration or to object to advertising.
Please note that your data will initially only be blocked if there are retention periods that prevent deletion.
3.2 Right to information
You can request that the contractor confirms to you whether it processes personal data relating to you and you have a right of access with regard to your data processed by the contractor, Art. 15 GDPR.
3.3 Right of rectification
According to Art. 16 of the GDPR, you are entitled to demand that the contractor corrects the personal data stored about you if it is inaccurate or incorrect.
3.4 Right to deletion
If the legal requirements are met, you can demand that the contractor immediately delete your personal data, Art. 17 GDPR. This is the case in particular if

your personal data is no longer needed for the purposes for which it was collected; the legal basis for the processing was solely your consent and you have revoked it;

you have objected to the processing for advertising purposes ("advertising objection");
-
you have objected to processing on the legal basis of balancing interests on personal grounds and the contractor cannot demonstrate that there are overriding legitimate grounds for processing;
-
your personal data have been processed unlawfully; or
-
Your personal data must be deleted to comply with legal requirements.
If the contractor has disclosed your data to third parties, the contractor will inform them of the deletion, insofar as this is required by law.
Please note that your right of deletion is subject to restrictions. For example, the contractor does not have to or may not delete any data that the contractor still has to retain due to statutory retention periods. Data that the contractor requires for the assertion, exercise or defence of legal claims are also excluded from your right of deletion.
3.5 Right to restrict processing
Provided that the legal requirements are met, you may request the Contractor to restrict processing, Art. 18 GDPR. This is the case in particular if

the accuracy of your personal data is disputed by you, and then until the contractor has the opportunity to verify the accuracy;
-
the processing is not lawful and you request restriction of use instead of erasure (see previous section); the contractor no longer needs your data for the purposes of processing but you need it to assert, exercise or defend your legal claims;
-
you have objected on personal grounds, and then until it is determined whether your interests prevail.
If there is a right to restrict processing, the contractor shall mark the data concerned in order to ensure in this way that they are now only processed within the narrow limits that apply to such restricted data (namely, in particular, for the defence of legal claims or with your consent).
3.6 Right to data portability
You have the right to receive personal data that you have given to the contractor for the performance of the contract or on the basis of consent in a transferable format, Art. 20 GDPR. In this case, you may also request that the contractor transfers this data directly to a third party, insofar as this is technically feasible.
3.7 Right to withdraw consent
If you have given the contractor consent to process your data, you can revoke this consent at any time with effect for the future. The lawfulness of the processing of your data until revocation remains unaffected.
3.8 Right to object on personal grounds
You have the right to object to data processing by the contractor for reasons arising from your particular situation, insofar as this is based on the legal basis of legitimate interest, Art. 21 GDPR. The contractor will then stop processing your data unless the contractor can prove - in accordance with the legal requirements - compelling reasons worthy of protection for the further processing, which outweigh your rights.

3.9 Right to complain to the supervisory authority
You have the right to lodge a complaint with a data protection authority. You can contact the data protection authority responsible for your place of residence or your federal state or the data protection authority responsible for the contractor. 4. Obligation to provide data
In principle, you are not obliged to provide the contractor with personal data. However, if you do not do so, the contractor will not be able to enable you to participate in the online offer or not completely. Personal data that the contractor does not necessarily require for the above-mentioned processing purposes are marked accordingly as voluntary information.
5. Up-to-datedness and amendment of this privacy policy
This privacy policy is currently valid and has the status August 2023.
